Terms and conditions of sale

These general terms and conditions of sale govern relations between VEGA BLUE S.A.S, owner of the HAROLD & MAUDE brand, with share capital of €1,000, whose registered office is at 78 avenue des Champs Elysées, 75800 Paris, registered in the Paris Trade and Companies Register under number 913 424 750, and customers wishing to place an order on the HAROLD & MAUDE website. https://haroldetmaude.eu/ (hereinafter "the Site").

The fact that any customer places an order on the Site implies their unreserved acceptance of these general terms and conditions of sale.

These terms and conditions of sale may be modified at any time by SAS VEGA BLUE.

Special terms and conditions for certain products or services may supplement these general terms and conditions. These will be specified when the article is presented.

If a condition is not met, it will be deemed to be governed by the practices in force in the sales sector.

The site and the ordering process are in French. 

  1. Controls

The customer, who certifies that he/she is of legal age and capable of entering into a contract, places his/her order in accordance with the procedures in force on the site and confirms the detailed summary of the order.

The customer is required to provide all reliable and accurate information necessary for identification and receipt of the order, in particular: surname, first name, e-mail address, password in the case of creation of a personal account, information necessary for delivery.  

If you create a customer account, you can change your personal details in your personal space. 

Items are subject to availability. 

If the item is not available, HAROLD & MAUDE will inform the customer as soon as possible by any means. 

VEGA BLUE cannot be held responsible for any event falling within the scope of force majeure. 

2. Awards

The prices shown are net prices including all taxes, and do not include delivery costs, which are payable by the customer for certain items (see article 3: "Contribution to delivery costs").

Payment for the order is made in advance. It is debited when the order is placed.

Prices are subject to change at any time.

An invoice is created for each shipment, enabling the guarantee to be activated. 

3. Contribution to shipping costs

All orders to be delivered are subject to delivery charges, but some may be offered depending on the HAROLD & MAUDE brand policy.

The amount of these charges depends on the size of the order and the country of delivery. 

The customer will be informed of any special conditions that may apply to delivery when the order is placed. 

The cost of delivery is shown in the basket details, in the order summary and on the invoice.

The customer acknowledges that he/she has been fully informed that a contribution to costs will be added to the price of the goods.

4. Order confirmation to the customer

Each order placed is associated with a unique order number.

HAROLD & MAUDE will inform the customer of the validation of his order by sending a summary e-mail. 

Only after validation by HAROLD & MAUDE will the customer's order be considered accepted. 

HAROLD & MAUDE reserves the right to cancel the order for any reason and will inform the customer if necessary.

5. Payment - Securing settlement transactions

The products and any shipping costs must be paid for as soon as the order is placed on the Site, by direct debit from your bank card. 

In the event that HAROLD & MAUDE is unable to ship part of an order, the customer's payment will be reduced by the price of the goods not shipped and any additional shipping costs.

6. Delivery

The delivery date is indicated when the customer places the order. 

However, this delivery date may be subject to change depending on the carrier.

In the event of a foreseeable extension of the delivery time, HAROLD & MAUDE will inform the customer as soon as possible and by any means so that the customer may choose to maintain or cancel all or part of the order.

If the order is placed more than seven (7) days after the date indicated at the time the order was placed, and except in cases of force majeure, the customer may cancel all or part of the order. 

HAROLD & MAUDE cannot be held responsible for the consequences of any event beyond its control, in particular force majeure or the fault of the carrier, which may delay or prevent delivery of the products ordered.

In the event of cancellation, the customer will be reimbursed within a maximum of fourteen (14) days following receipt of the cancellation request. 

Deliveries are made worldwide, unless HAROLD & MAUDE is unable to fulfil the order. 

Deliveries are made to the delivery address indicated by the customer. 

HAROLD & MAUDE cannot be held responsible for the non-receipt of the order by the customer in the event of an error in the information provided. 

7. Distance selling - Right of withdrawal - Return of products

In application of article L.121-21 of the French Consumer Code, the customer has the right to withdraw from all or part of their order, without giving any reason, and which expires fourteen (14) days from receipt of the products ordered, or if several products are ordered in a single order, on receipt of the last item ordered.

However, products personalised specifically for the customer may not be retracted. 

To exercise the right of withdrawal, the customer must notify HAROLD & MAUDE by any means of his decision to withdraw from these general conditions of sale by means of an unambiguous statement. 

In the event of retraction, the products must be returned within fourteen (14) days of notification of the exercise of the right of retraction, in their original packaging and accompanied by any accessories and instructions, as well as the duly completed returns slip included in the parcel.

To return a product, the customer must first contact HAROLD & MAUDE who will provide the necessary information for the return. 

Items returned incomplete, damaged, used or soiled cannot be taken back.

Only the price of the product(s) purchased and the delivery costs (excluding any additional costs) will be refunded to the customer. 

The cost of returning the product(s) shall be borne by the Customer. 

Reimbursement will be made no later than fourteen (14) days from the date of recovery of the products from the order that was the subject of the withdrawal. 

Refunds are made using the same payment method as the initial payment. 

8. Legal warranties

These provisions do not apply to professionals within the meaning of the Consumer Code. 

The seller is liable for any lack of conformity of the goods with the contract in accordance with Articles L217-3 to L217-20 of the French Consumer Code and for any hidden defects in the goods sold in accordance with Articles 1641 et seq. of the French Civil Code. 

Under the legal guarantee of conformity, the consumer has a period of two years from the date of delivery of the goods in which to invoke the guarantee. During this period, the consumer benefits from a presumption of non-conformity.

The legal guarantee of conformity gives the consumer the right to repair or replace the goods within thirty days of his request, free of charge. 

If the goods are repaired under the legal conformity guarantee, the consumer benefits from a six-month extension to the initial guarantee. 

If the seller is unable to meet the consumer's request for repair, and if the product is replaced, the legal guarantee of conformity is renewed for a further period of two years from receipt of the replaced product. 

The property must be brought into compliance within no more than thirty days.

The consumer is entitled to a reduction in the price of the goods or to rescission of the contract in the following cases:

  1. When the professional refuses to comply;
  1. If compliance is not achieved within thirty days of the consumer's request or if it causes him a major inconvenience;
  1. If the consumer definitively bears the costs of taking back or removing the non-conforming goods, or if he bears the installation of the repaired or replacement goods or the related costs;
  1. When the non-conformity of the property persists despite the seller's unsuccessful attempt to bring it into conformity.

The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract where the lack of conformity is so serious as to justify immediate reduction in the price or rescission of the contract. In such cases, the consumer is not obliged to ask for the goods to be repaired or replaced beforehand.

The consumer does not have the right to rescind the sale if the lack of conformity is minor, which is for the seller to demonstrate. This paragraph does not apply to contracts in which the consumer does not pay a price.

Any period during which the goods are immobilised with a view to their repair or replacement suspends the warranty that was in force until the delivery of the repaired goods. 

9. Products

Customers must familiarise themselves with the instructions for use or any other information attached to the product or marked on the product or its packaging (precautions for use, conditions of use, etc.).

The products must be used only in accordance with the precautions for use provided by HAROLD & MAUDE. 

HAROLD & MAUDE cannot be held responsible for any misuse of the product by the customer who has not respected the aforementioned precautions for use, particularly those concerning safety.

10. Data protection policy 

As the data controller, HAROLD & MAUDE ensures that your personal data is protected in accordance with current regulations. 

The data protection policy is accessible on the Site. 

11. Retention of title - transfer of risk

Delivered products remain the property of HAROLD & MAUDE until full and effective payment of the price by the customer. 

The customer shall bear all risk of loss or damage to the products from receipt of the order. 

12. Intellectual Property

All elements of the Site are protected by copyright, trademarks or patents and are the exclusive property of VEGA BLUE. 

13. Integral

The invalidity of any of the clauses of this contract shall in no way affect the validity of or compliance with these general terms and conditions of sale.

14. Duration

These general terms and conditions of sale apply for as long as the services offered by VEGA BLUE are online and may be modified at any time. 

15. Applicable law and jurisdiction

These terms and conditions are governed by French law.

Disputes arising from the application of these general terms and conditions of sale are subject to French law and may be heard only by the French courts.

The consumer customer may, after having tried at any time to settle his/her dispute directly with HAROLD & MAUDE, resort to mediation or any other alternative dispute resolution method, after having tried to settle the dispute with our customer service department.

TEST YOUR FRAGRANCE BEFORE YOU BUY" OPERATION:

You can return your 100ml eau de parfum spray within 14 days of delivery if you are not satisfied with your sample.

This right of withdrawal only applies to 100ml eau de parfum sprays that have not been opened and whose protective cellophane has remained perfectly intact. It must be returned to us in its original packaging with the protective cellophane perfectly in place.
